Terms of Service

These terms govern your use of the My Gift Brain iOS application (the "app") and the website at mygiftbrain.app (together, the "service"), provided by MVCS ApS ("we", "us"). By downloading or using the app you agree to these terms. If you do not agree, please do not use the service.

1. The service

My Gift Brain is a personal tool for remembering gift ideas for the people in your life. It stores your data locally on your iPhone and optionally syncs through your own Apple iCloud account. The service is provided on an "as is" and "as available" basis.

2. Your account

There is no separate My Gift Brain account. Your identity in the service is your Apple ID. Apple's Terms of Service for the App Store apply to your purchase and use of the app.

3. Purchase

• The app is sold as a one-time purchase at the price displayed in the App Store at the time of purchase. There is no subscription and no renewal.
• Payment is charged to your Apple ID. All billing is handled by Apple under their standard terms.
• Your licence to use the app does not expire, provided you remain signed in to the Apple ID that made the purchase and the app remains available on the App Store.
• Except where required by law, payments are non-refundable. Refund requests should be directed to Apple.

4. Acceptable use

The app is intended for personal, non-commercial use. You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the app, except where such restriction is prohibited by applicable law.
• Use the service in violation of any law, regulation, or third-party right.
• Attempt to interfere with, compromise, or disrupt the service.

5. Your content

You own all the content you add to the app (people, ideas, photos, notes). We claim no rights over it. Because your data is stored in your own iCloud account, we cannot access, export, or recover it on your behalf.

6. Intellectual property

The app, its brand, logo, wordmark, and all associated materials are the property of MVCS ApS and are protected by copyright and trademark laws. You are granted a limited, revocable, non-transferable licence to use the app for personal purposes consistent with these terms.

7. Service changes

We may add, change, or remove features as the app evolves. We try to avoid breaking changes for existing users, but reserve the right to discontinue features with reasonable notice.

8. Termination

You may stop using the app at any time by deleting it from your devices. We may suspend or terminate your access if you materially breach these terms.

9. Disclaimer of warranties

To the maximum extent permitted by law, the service is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, MVCS ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from your use of the service. Our total aggregate liability for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing law

These terms are governed by applicable consumer-protection law, without prejudice to any mandatory consumer rights you may have in your country of residence.

12. Changes to these terms

We may update these terms from time to time. Material changes will be announced on this page. Continued use of the app after such changes constitutes acceptance of the updated terms.
